DMCA Policy

Shish Tawook is committed to respecting the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the following policy concerning copyright infringement.

This policy outlines the procedures for copyright holders to notify us of alleged infringement and for users to respond to notices of infringement.

Filing a DMCA Notice of Infringement

If you believe that your copyrighted work has been copied and is accessible on Shish Tawook's website or services in a way that constitutes copyright infringement, you may notify our Designated Copyright Agent by providing the following information in writing:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
  2. A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
  3. Identification of the URL or other specific location on our website or service where the material that you claim is infringing is located.
  4. Your name, address, telephone number, and email address.
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Upon receipt of a valid DMCA notice, Shish Tawook will promptly investigate the complaint and take appropriate action, which may include removing or disabling access to the infringing material.

Filing a DMCA Counter-Notification

If you believe that material you posted on our site was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification by providing the following information in writing:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Shish Tawook may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, Shish Tawook will forward it to the original complaining party. If the complaining party does not file an action in court within 10-14 business days, we may restore the removed material, provided we have not been notified that the complaining party has filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on our service.
